Solicitation
Solicitation means the sale or offer for sale of any property, goods, products, or services, including the distribution of literature to promote a commercial message; or the receipt of or request for any gift or contribution.
Types of Solicitation
- On-Campus Solicitation
- Co-Sponsorship of Vendor - University Departments only
- Raffles on Campus
- Off-Campus Solicitation
On-Campus Solicitation
Overview
Solicitation on campus is prohibited, except for the activities described in UPPS No. 07.04.03 - Solicitation on Campus. Solicitation is only allowed in defined outdoor spaces:
- San Marcos Campus: Bobcat Trail, The Mall, LBJ Student Center Patio, and The Quad
- San Marcos Campus: Sewell Park
- Round Rock Campus: Avery Building - inside foyer and fourth floor common areas, and grassy mall on south side of building
Update - August 2024
- LBJ Student Center Event Services will oversee the review and approval of outdoor space reservation requests.
- Student Involvement & Engagement - Operations & Assessment (SI&E) will continue to review and approve requests for solicitations.
- A Solicitation Request Form is no longer needed as part of the Outdoor Space Request.
- LBJSC Event Services has included intake questions regarding solicitation as part of the Outdoor Space Reservation Requests process.
- LBJSC and SI&E are working collaboratively to review and approve all requests.
Make a reservation for an outdoor space via LBJ Student Center Event Services:
LBJSC Event Services will review all requests on a first-come, first-serve basis, and will determine and communicate approvals at least 72 hours of request being made.
First Availability to Make a Request
Reservation requests can be made for any date during a full and current semester. For fall 2024, reservation requests can be through fall 2024 and until December 21, 2024.
Co-Sponsorship of Vendor - University Department Only
Update - July 2024
- Only Texas State University departments (i.e., unit, office, center, etc.) are permitted to co-sponsor a vendor(s) [i.e., business, organization, group, or persons] to access and solicit on the San Marcos and Round Rock campuses.
Overview
The Co-sponsor's Notification of External Vendor is a required component of Solicitation on Campus at Texas State University when a university department seeks to invite and host a vendor to solicit on campus in an outdoor space.
University departments will provide notification as part of their reservation requests for Outdoor Space(s) in the Mazevo Reservation System.
Definitions
A co-sponsor:
- is a university department that will serve as an official host and is ultimately responsible for vendor(s),
- ensures that the vendor(s) follows all university policies, practices, rules, and regulations while on campus,
- completes all required and supplemental requests and forms, and
- is required to be physically present with the vendor(s) for the duration of the time the vendor(s) is on campus.
Vendors are:
- non-university entity (i.e., business, organization, group, or persons) seeking access to the Texas State University San Marcos or Round Rock campuses.
Raffles On- and Off- Campus
Overview
Groups authorized to conduct raffles under the Charitable Raffle Enabling Act (Art. 179 F, Vernon’s Texas Civil Statutes), hereafter referred to as a qualified organization, may conduct raffles on campus, if approved, with proper documentation, by Student Involvement & Engagement or by the Round Rock Student Success supervisor, or designee.

Qualified Organizations
Qualified organizations include non-profit organizations that:
- have existed for at least three preceding years and are exempt from federal income tax under Section 501(c), Internal Revenue Code;.
- do not distribute any of their income to their members, officers, or governing body;
- do not devote a substantial part of their activities to attempting to influence legislation; and
- do not participate in any political campaign.

Procedure
Groups wishing to conduct raffles on- or off-campus must meet with Student Involvement & Engagement or with the Round Rock Student Success supervisor, or designee, at least 10 university business days prior to requested dates to review state of Texas and university policies and procedures related to conducting raffles.
Off-Campus Solicitation
Overview
For soliciting sponsorships, goods, donations, in-kind contributions, and/or items of monetary value from non-TXST off-campus entities.
In order to maintain the good will of our local community and encourage maximum private support, the university will coordinate and approve off-campus solicitation by registered student organizations and university departments, as outlined in UPPS No. 03.06.01, Off-Campus Solicitation by Registered and Chartered Student Organizations.
Procedures
- All registered student organizations desiring to solicit off-campus must obtain a Permit to Solicit Funds Off-Campus form from the Student Involvement & Engagement.
- Completed forms, along with a draft of the requested letter or materials, must be submitted to the SI&E, or designee, who will approve and forward to the Vice President for University Advancement (VPUA) for final approval.
- The VPUA will approve all solicitation correspondence to vendors before distribution. If the solicitation is approved, the form must be shown to all merchants from whom funds are solicited.
